By accessing or using NetGarden services, you acknowledge that:

- You have the legal capacity to enter into a binding agreement
- You have read, understood, and agree to be bound by these Terms
- You will comply with all applicable laws and regulations
- All information provided by you is accurate and truthful
2. Service Description
2.1 Broadband Internet Service
NetGarden provides high-speed fiber broadband internet services with speeds up to 300 Mbps. Our
services include:
- High-speed internet connectivity
- Unlimited data usage (subject to fair usage policy)
- 24/7 customer support
- Network equipment (as per plan)
- Installation and setup services
2.2 Service Availability
Service availability is subject to:
- Technical feasibility at your location
- Network infrastructure availability
- Regulatory approvals and permissions
- Force majeure events beyond our control
We strive to provide 99.9% network uptime but do not guarantee uninterrupted service.
3. Service Plans and Pricing
3.1 Plan Selection
You may choose from available service plans. Plan details, including speeds, features, and
pricing, are subject to change. Current plans are available on our website.
3.2 Pricing and Billing
- All prices are in Indian Rupees (₹) and are exclusive of applicable taxes
- Billing is done monthly in advance
- Payment is due on or before the due date specified on your invoice
- Late payment fees may apply for overdue accounts
- We reserve the right to modify pricing with 30 days' notice to existing customers
3.3 Plan Changes
You may upgrade or downgrade your plan at any time. Changes will be effective from the next
billing cycle. Pro-rated charges or credits may apply.
4. Installation and Equipment
4.1 Installation
- Installation will be scheduled at a mutually convenient time
- You must provide access to the installation location
- Installation fees may apply (varies by plan and location)
- You are responsible for ensuring proper permissions and approvals for installation
4.2 Equipment
- Equipment provided by NetGarden remains our property unless purchased
- You are responsible for the care and security of the equipment
- Equipment must be returned in good condition upon service termination
- Damage or loss of equipment may result in charges
- You may not modify, tamper with, or relocate equipment without authorization
5. Acceptable Use Policy
5.1 Permitted Use
You may use our services for lawful purposes only, including:
- Personal and business internet access
- Streaming, gaming, and entertainment
- Remote work and telecommuting
- Educational and research purposes
5.2 Prohibited Activities
You agree NOT to use our services for:
- Any illegal activities or violation of laws
- Transmission of viruses, malware, or harmful code
- Unauthorized access to systems or networks
- Spam, phishing, or fraudulent activities
- Copyright infringement or piracy
- Network abuse, including excessive bandwidth consumption that affects other users
- Resale or redistribution of services without authorization
- Any activity that disrupts or interferes with network operations
5.3 Fair Usage Policy
While we offer unlimited data, excessive usage that impacts network performance may result in:
- Speed throttling during peak hours
- Notification to adjust usage patterns
- In extreme cases, service suspension or termination
6. Payment Terms
6.1 Payment Methods
We accept payments through:
- Credit/Debit cards
- Bank transfers
- UPI payments
- Online payment gateways
- Auto-debit facilities (where available)
6.2 Payment Obligations
- You are responsible for timely payment of all charges
- Failure to pay may result in service suspension or termination
- Reconnection fees may apply after service suspension
- You are responsible for all charges incurred on your account
6.3 Disputes and Refunds
Billing disputes must be reported within 30 days of the invoice date. Refund policies are

7. Service Limitations and Disclaimers
7.1 Speed and Performance
- Advertised speeds are maximum theoretical speeds and may vary
- Actual speeds depend on various factors including network congestion, device capabilities,
and server locations
- We do not guarantee specific speeds but strive to provide the best possible service
7.2 Service Interruptions
Service may be interrupted due to:
- Scheduled maintenance (with advance notice where possible)
- Emergency repairs
- Force majeure events (natural disasters, government actions, etc.)
- Third-party service provider issues
- Customer equipment or configuration issues
7.3 Limitation of Liability
To the maximum extent permitted by law:
- NetGarden is not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount paid by you in the 12 months preceding the
claim
- We are not responsible for data loss, security breaches, or unauthorized access
- We are not liable for third-party content, services, or websites
8. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information
is governed by our Privacy Policy, which forms part of these Terms. By using our services, you
consent to our privacy practices as described in the Privacy Policy.
9. Intellectual Property
- All content, trademarks, logos, and intellectual property on our website and services belong
to NetGarden or our licensors
- You may not copy, modify, distribute, or use our intellectual property without written
permission
- You retain ownership of content you create or transmit using our services
- You grant us a license to use your content as necessary to provide services
10. Termination
10.1 Termination by You
You may terminate service at any time with 7 days' notice. Termination procedures are detailed in
our Refund & Cancellation Policy.
10.2 Termination by Us
We may terminate or suspend your service immediately if:
- You violate these Terms or our Acceptable Use Policy
- You fail to pay charges when due
- You engage in illegal or fraudulent activities
- You breach any applicable laws or regulations
- Technical or operational reasons require termination
10.3 Effect of Termination
- All access to services will cease
- All outstanding charges become immediately due
- Equipment must be returned as per policy
- We may delete your account and data after a reasonable retention period
11. Indemnification
You agree to indemnify and hold NetGarden, its officers, employees, and partners harmless from
any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use or misuse of our services
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Content you transmit or store using our services
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive
jurisdiction of courts in the jurisdiction where NetGarden operates.
12.2 Dispute Resolution Process
- First, contact our customer support to resolve the issue
- If unresolved, escalate to our management team
- We encourage good faith negotiation to resolve disputes
- Legal action may be pursued if disputes cannot be resolved amicably
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to
you via:
- Email notification to your registered email address
- Notice on our website or customer portal
- In-app notifications (where applicable)
Continued use of our services after changes constitutes acceptance of the modified Terms. If you
do not agree to the changes, you must terminate your service.
14. Force Majeure
NetGarden is not liable for failure to perform obligations due to circumstances beyond our
reasonable control, including:
- Natural disasters, fires, floods, or earthquakes
- War, terrorism, or civil unrest
- Government actions, regulations, or restrictions
- Strikes, labor disputes, or supplier failures
- Pandemics or public health emergencies
- Network outages or infrastructure failures beyond our control
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining
provisions will continue in full force and effect. The invalid provision will be replaced with a
valid provision that most closely reflects the intent of the original.
16. Entire Agreement
These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the
entire agreement between you and NetGarden regarding the use of our services and supersede all
prior agreements and understandings.
